TRANSFER OF REAL-ESTATE PROPERTIES

Before you buy a property in Costa Rica, it is advisable to take certain precautions. It is necessary to corroborate the legal state of the property in the Public Registry since the properties may have mortgage liens or existing entries. It is also necessary to verify the status of the payment of local governments’ taxes on the corresponding municipality. After verifying the legal status of the property and previous studies conducted, it is advisable to negotiate with the seller through a contract called "promise of sale". Our lawyers draw up the contract taking into account the provisions of both parties. PAYMENT OF PROPERTY TAXES 

If a property is acquired in Costa Rica, it is require to make a quarterly payment of real-estate property taxes to the nearest local government. These taxes are paid at a rate of 0.25% of the value of the property as declared by the taxpayer and accepted by the municipality. These authorities do not personally notify each property owner and lack of payment of this tax may generate serious consequences on the property. LOANS ON PROPERTIES, MORTGAGES, TRUST, AND CANCELLATION OF ENCUMBRANCES.

To obtain financing, it can be granted any type of security documents on loans. The most common way of doing it, is to make transactions with banking institutions; however you can create mortgages with any natural or legal Costa Rican person dedicated to provide financing services. Our Notaries will guide you through the process of creating the proper legal instrument, impartially advising on the transaction, creating the mortgage or trust, and registering the documents produced in the Public Registry. POWER OR AUTHORIZATION TO PURCHASE - SALE OF PROPERTY.

In order to purchase or sale real property in Costa Rica, the transfer deed must be signed by the registered owner or by a special representative for this act. This power must be created before a notary public in Costa Rica or, if the person is abroad, it may be granted in the Costa Rican Consulate of the country where the person is located and be sent with the formalities of law to Costa Rica. In the case of corporations, the representative with sufficient power for the acquisition is the person authorized to sign the document. If the representative is not in the country, it can be created a special power to buy or sell a property in Costa Rican territory which may be granted by the General Assembly of the Corporation in the legal books of the entity. Once created, the power must be notarized by one of our notaries in order to be able to sign the closing document. In the event that the constitution of society allows this power may be executed directly by proxy.
